Draft. These terms haven’t been reviewed by a lawyer yet and aren’t in effect. Sections marked [to confirm] need a decision before launch.
Terms of Use
These terms are an agreement between you and Velez Health, Inc. (“we”, “us”) for using the firstlife app and website. By creating an account, you agree to them and to our Privacy Policy.
1. firstlife isn’t medical care
firstlife is a tool for organizing your own information. It doesn’t give medical advice, diagnose anything, or replace a doctor. Trends, flags such as “worse since visit”, suggested questions and articles are there to help you talk with your care team, not to tell you what’s wrong or what to do. Always talk to a qualified provider about your health. If you think you have an emergency, call 911 or your local emergency number right away. Don’t wait for or rely on the app.
2. Who can use it
You must be 18 or older and live in the United States or Canada. You’re responsible for keeping your password safe and for what happens in your account. Tell us right away at support@healthbyvelez.com if you think someone else has used it.
3. Recording visits and calls
firstlife lets you record visits and phone calls. Many places, including California, Massachusetts and Washington, require everyone in a conversation to agree before it’s recorded. You must tell everyone you’re recording and get their permission before you start, and follow the law where you and they are. The app asks you to confirm this every time. You’re responsible for your recordings and how you use them.
4. Your information stays yours
You own everything you add to firstlife. You give us permission to store, process and display it only to run the app for you, as our Privacy Policy describes. This permission ends when you delete the information or your account, except for backup copies, which are erased within 30 days.
5. Using firstlife fairly
Don’t:
- use firstlife to break the law, or to record or upload information about other people without the right to do so
- try to access another person’s account or information, or get around our security
- overload, disrupt or reverse-engineer the service, except where the law allows it
- use the app or its content to build a competing product
6. Third-party services
Some features use other services, such as Google Calendar, your phone’s dialer, maps apps, and the US government’s NPI provider directory. Their own terms apply when you use them. Provider details from the directory may be out of date, so check with the office before you rely on them.
7. Changes and availability
We may add, change or remove features. We’ll try to keep firstlife available, but we can’t promise it will always work without interruption. Keep your own copies of important records, and export your data regularly.
8. Ending your account
You can delete your account at any time in Settings. We may suspend or close an account that breaks these terms or puts others at risk. Where we can, we’ll tell you first and give you a chance to export your data.
9. Disclaimers
firstlife is provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy. Some places don’t allow these disclaimers, so they may not all apply to you.
10. Limit on liability
As far as the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for decisions you or a provider make based on the app. Our total liability for any claim about firstlife is limited to the greater of what you paid us in the 12 months before the claim or US $100. Nothing in these terms limits liability that can’t be limited by law, or your rights under consumer protection laws where you live.
11. Governing law [to confirm]
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. If you live in Canada, the laws of your province also apply where they give you more protection.
12. Changes to these terms
If we make a meaningful change, we’ll tell you in the app or by email at least 14 days before it takes effect. If you keep using firstlife after that, you accept the new terms. If you don’t agree, you can delete your account.
